Terms and Conditions of Sale

1. Seller information

The seller is Mazara Distribution S.r.l., with registered office at Via Lombardia 11, 20052 Vignate (MI), Italy – VAT and Tax Code 12699850967 (the “Seller”).

2. Subject

These Terms govern the distance purchase of seafood and food products through the Site. Contracts concluded on the Site are governed by Italian law, in particular Legislative Decree no. 206 of 6 September 2005 (the “Consumer Code”) and Legislative Decree no. 70 of 9 April 2003 on electronic commerce.

3. Definitions

• Customer / Consumer: the natural person acting for purposes unrelated to their business, commercial, craft or professional activity.
• Products: the food goods offered for sale on the Site.
• Order: the purchase proposal sent by the Customer through the Site.
• Consumer Code: Legislative Decree 206/2005 as amended.

4. Products and availability

The Products sold are fresh, perishable and seasonal food. Images and descriptions are indicative and may slightly differ from the actual product (weight, size, colour).

Availability depends on the daily catch and sea conditions. If a Product becomes unavailable after the order, the Return and Refund Policy applies.

5. Prices

All prices on the Site are in Euro and include VAT. Any shipping costs are shown separately before order confirmation and summarised in the cart.

The price applied is the one shown on the Site at the time the order is placed.

6. Conclusion of the contract

The contract is concluded when the Seller confirms acceptance of the order by sending a confirmation email to the address provided by the Customer, summarising the Products, the price and shipping costs.

The Seller reserves the right not to process incomplete orders or orders for unavailable Products, promptly informing the Customer.

7. Payment methods

Payment is made at the time of the order through the secure checkout provided by Shopify.

• Credit/debit cards and major digital wallets.
• Instalment payment via Scalapay, where available, under the relevant provider's terms.

8. Delivery

Products are delivered with refrigerated transport (0–4 °C) to protect the cold chain, within the served areas indicated on the Site.

Deliveries take place from Tuesday to Saturday by 1:00 PM; for order cut-off times please refer to the delivery information published on the Site.

As these are perishable products, the Customer must ensure a recipient is present at the indicated address during delivery hours.

9. Right of withdrawal and exclusions

Pursuant to art. 52 et seq. of the Consumer Code, consumers generally have the right to withdraw from distance contracts within 14 days without giving any reason.

Exclusion applicable to the Seller's products. Pursuant to art. 59 of the Consumer Code, the right of withdrawal is excluded, among others, for: the supply of goods liable to deteriorate or expire rapidly; the supply of sealed goods which are not suitable for return for health protection or hygiene reasons and which were unsealed after delivery; the supply of goods made to the consumer's specifications or clearly personalised.

Since the Products offered on the Site are fresh, perishable and/or sealed for hygiene reasons, the right of withdrawal does not apply to purchases made. The Customer's rights in the event of non-conforming, damaged or unavailable products, governed by the Return and Refund Policy, remain unaffected.

Electronic withdrawal function. Where, for any non-perishable products not falling within the above exclusions, a right of withdrawal exists, the Customer may exercise it — in accordance with art. 54-bis of the Consumer Code introduced by Legislative Decree 209/2025 — by sending an explicit and unequivocal statement, including by means of the model withdrawal form (Annex I, part B, of the Consumer Code), to info@mazaradistribution.com. The Seller will send, without undue delay, an acknowledgement of receipt of the withdrawal on a durable medium (email).

10. Legal guarantee of conformity

The Products are covered by the legal guarantee of conformity under art. 128 et seq. of the Consumer Code. As these are perishable food products, any lack of conformity or quality issues must be reported within 24 hours of delivery, with photographic documentation, as set out in the Return and Refund Policy.

11. Complaints and support

For any complaint or support request, the Customer may contact the Seller at info@mazaradistribution.com or via WhatsApp at +39 334 932 1226. Complaints are handled within 48 hours of the report.

12. Liability

The Seller is not liable for disruptions due to force majeure or unforeseeable events, nor for improper use or storage of the perishable Products by the Customer after delivery.

13. Intellectual property

All Site content (trademarks, logos, texts, images, graphics) is owned by Mazara Distribution S.r.l. or the respective owners and is protected by intellectual property laws. Any unauthorised reproduction is prohibited.

14. Applicable law and dispute resolution

These Terms are governed by Italian law. For disputes with consumers, the court of the consumer's place of residence or domicile, if located within the State, has exclusive jurisdiction.

The consumer may also resort to the alternative dispute resolution (ADR) bodies competent under art. 141 et seq. of the Consumer Code.

15. Processing of personal data

The processing of the Customer's personal data is governed by the Privacy Policy and the Cookie Policy published on the Site, which form an integral part of these Terms.

16. Changes to the Terms

The Seller reserves the right to amend these Terms at any time. The applicable version is the one published on the Site at the time the order is placed. Customers are invited to review this page periodically.
